05 /19.02.2026: I.A. No.16583 of 2025 This interlocutory application has been filed by the appellant, praying therein to suspend the sentence and release him on bail during the pendency of this appeal.

2. This is second attempt of the appellant praying for suspension of sentence and release on bail during the pendency of this appeal.

3. The appellant has been convicted and sentenced in connection with in Tenughat in S.T. No.79 of 2015, for the offence under Section 302 of the IPC. He has been sentenced to undergo rigorous imprisonment for life and with a fine of Rs.10,000/- for the offence under Section 302 of IPC.

4. Heard, the learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

5. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

6. The appellant is now in custody for more than 11 years. Though there is an allegation of assaulting by axe by this appellant upon the deceased, but admittedly only one blow was given.

7. The genesis of the occurrence is that there was a dispute between the appellant and the deceased in respect of the mango tree of this appellant branches of which the deceased had chopped.

8. Considering the nature of the allegations and the assault and also the fact that the appellant is in custody for more than 11 years and it is not possible for this Court to hear this appeal.

9. Accordingly, upon suspending the sentence, the appellant, named above is directed to be released on bail during the pendency of this appeal, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge-II, F.T.C. (C.A.W), Bermo at Tenughat, in connection with Tenughat in S.T. No.79 of 2015, with a condition that one of the bailers must be a close relative of the appellant and with a further condition that the appellant shall appear and mark his attendance before the Registrar, Civil Court, Bokaro once in every three months till the disposal of this appeal.

10. Accordingly, I.A. No.16583 of 2025 stands allowed.
