04/ 07.10.2025     Learned counsel appearing for the petitioner submits that the

petitioner is the husband of O.P. No. 2. He submits that the trial has taken

place against the petitioner as well as other accused persons, however, the

learned trial court has acquitted the other co-accused persons and only

conviction has been made to this petitioner. He submits that the learned

Judicial Magistrate, 1st Class-VIII, Ranchi by the judgment dated

19.08.2024, in connection with Mahila P.S. Case No. 19 of 2011

corresponding to G.R. No. 3806 of 2011 (T.R. No. 24 of 2024), has been

pleased to convict the petitioner and sentenced him to undergo R.I. for

three years and fine of Rs. 10,000/- for the offence under Section 498-A of

the Indian Penal Code. He further submits that said order of the learned

trial court has been affirmed by the learned revisional court by judgment

dated 07.10.2024, passed in Criminal Appeal No. 320 of 2024. Learned

counsel next submits that the learned trial court, although has recorded in

the judgment that the compromise between the parties has taken place, in

spite of that the conviction has been made to the petitioner.

2. I.A. No. 10595 of 2025 has been filed by the petitioner for

grant of bail to him, during the pendency of this petition.

3. Learned counsel appearing for the petitioner submits that the

petitioner has retired from service on 31.08.2023 from the post of Block

Co-operate Extension Officer from Munger district of the State of Bihar.

He submits that the wife of this petitioner is also an Accountant in the

office of the Superintendent of Police, Bokaro. He further submits that the

petitioner is in custody since 08.07.2025. He next submits that the

petitioner may kindly be allowed on bail.

4. Mr. Aman Kumar, learned counsel has put his appearance suo

motu on behalf of O.P. No. 2 by way of filing his vakalatnama and he

seeks time to assist the court.

5. Learned A.P.P. appearing for the State submits that the

petitioner is the husband and he has rightly been convicted.

6. In view of the above submissions of the parties and further

this matter is still pending before this court and the petitioner is in custody

since 08.07.2025, the petitioner, named above, is directed to be released

on regular bail, during the pendency of this petition, on furnishing bail

bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of

the like amount each to the satisfaction of learned Judicial Magistrate, 1st

Class-VIII, Ranchi, in connection with Mahila P.S. Case No. 19 of 2011

corresponding to G.R. No. 3806 of 2011 (T.R. No. 24 of 2024).

7. As such, I.A. No. 10595 of 2025 is allowed and disposed of.

8. In the meantime, call for the Trial Court Records.

9. I.A. No. 13554 of 2024 has been filed by the petitioner for

exemption from surrender.

10. Learned counsel appearing for the petitioner submits that this

I.A. has become infructuous.

11. In view of his such submission, said I.A. No. 13554 of 2024 is

dismissed as infructuous.
