CORAM: HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY

Order No.02 Dated- 02.05.2025

Heard the parties.

The petitioner has moved this Court for grant of bail in connection with Chhattarpur P.S. Case No.103 of 2024 registered for the offences punishable under sections 356/382 of the Indian Penal Code.

The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is a habitual offender and he snatched the polythene bag containing 89,000/- from the informant and he has been identified in the T.I.P. It is further submitted by the learned counsel for the petitioner that the petitioner is also involved in five other cases though it is claimed that he has been acquitted in all the cases but neither the case numbers nor the judgment of acquittal has been annexed herewith. The learned P.P. opposes the prayer for bail and submits that keeping in view the serious nature of allegation against the petitioner, there is every chance of the petitioner absconding, if released on bail.

Considering the serious nature of allegation against the petitioner of being a habitual offender involved in committing robbery and as he has been identified in the T.I. Parade as well as the chance of his absconding, if released on bail, this Court is not inclined to admit the petitioner on bail. Accordingly, the prayer for bail of the above-named petitioners is rejected.
