1. It appears that the petitioner has superannuated on 31.10.2022.
2. It has been submitted by the learned counsel for the petitioner that the wife of the petitioner is suffering from cancer. Further, it has been submitted that there is no concept of withholding of the pension in the absence of any order passed by the Competent Authority.
3. For this purpose, she has relied upon the judgment passed by the Hon'ble Apex Court in the case of State of Jharkhand & Others versus Jitendra Kumar Srivastava and Another as reported in (2013) 12 SCC 210.
4. Accordingly, put up this case on 20.06.2025.
5. Meanwhile, either respondents shall comply the order or they must come up with legally acceptable reason, otherwise, it will be presumed that the respondents are acting beyond the mandate of law. Acting beyond the mandate of law is nothing, but utmost corruption.
6. For the compliance of this order, the Secretary, Department of School Education & Literacy Development is held responsible.
