07/25.03.2025 Looking into the prayer made in the petition, the Court has called upon
the learned counsel for the petitioners to address the Court.
2. This petition has been filed under Article 227 of the Constitution of
India for direction upon the learned trial court to expedite the trial as early
as possible arising out of the Partition Suit No.36 of 2000, pending in the
Court of the learned Civil Judge (Senior Division)-I, Hazaribag. The further
prayer is made for disposal of the Misc. Case No.21 of 2018 arising out of
Partition Suit No.36 of 2000.
3. Learned counsel for the petitioners submits that appropriate direction
may kindly be issued for early disposal of the said case.
4. Learned counsel for the opposite parties jointly submit that the said
Partition Suit No.36 of 2000 has already been dismissed for default vide order
dated 10.05.2018 and for restoration of the said suit, Misc. Case No.21 of
2018 has been filed, which is still pending.
5. From the record, the Court finds that there is nothing on record to
suggest that the learned Court is at fault in not disposing of the said Misc.
Case. Unless restoration is made, the hearing cannot be made in the said
partition suit. In view of that, the petitioners are required to pursue the said
Misc. Case No.21 of 2018 diligently for early disposal.
6. In light of the judgment passed in the case of High Court Bar
Association, Allahabad v. State of Uttar Pradesh and others, reported
in (2024) 6 SCC 267, the Hon'ble Supreme Court has held in paragraph
47.3 that the Constitutional Courts are not required to issue direction to the
learned Courts for early disposal of the cases and it is for the learned Courts
to prioritise for disposal of the cases and in view of that, no positive order
can be passed in this petition.
7. Accordingly, this petition is disposed of with liberty to the petitioners
to pursue the said Misc. Case diligently before the learned Court for early
disposal.
