05/20.03.2025 I.A. No.2035 of 2025 has been filed for substitution of legal
heirs/successors of respondent no.5 before the learned appellate court,
namely, Tejo Pandit.
2. Learned counsel for the appellants submits that Tejo Pandit
(respondent no.5 in Civil Appeal No.35 of 2023) has left for his heavenly
abode on 06.11.2023 prior to the judgment dated 07.12.2023 passed by the
learned appellate court and his legal heirs/successors are already on record
in the present second appeal as respondent nos. 2 to 4 and in view of that,
the surviving defect may kindly be ignored.
3. In view of the above and considering that legal heirs/successors of Tejo
Pandit are already on record as respondent nos. 2 to 4 in the present second
appeal, the defect pointed out by the office is, hereby, ignored.
4. Accordingly, I.A. No.2035 of 2025 is disposed of.
5. Office will proceed further as per the procedure.
