06/11.03.2025          Learned counsel for the appellants has submitted that defect no.

23, as pointed out by the office, be ignored, inasmuch as, page no. 20 of certified copy of the impugned judgment has been tagged twice. He submits that whatever was the certified copy issued from the concerned Court, has been filed.

2. It seems that while issuing the certified copy, page no. 20 of the impugned judgment has been placed twice.

3. Having gone through the impugned judgement , the defect no. 23 is hereby ignored.

4. Learned counsel for the appellants has submitted that this interlocutory application has been filed for deleting the name of appellant nos. 2, 3, 4 and 6 from the memo of appeal on the ground that they are not the directors of the appellant no. 1.

5. During the course of hearing, it is not in dispute that appellant nos. 2, 3, 4 and 6 were party in the suit before the learned Court.

6. In such circumstances, this Court is not inclined to allow I.A. No. 3167 of 2025 which is hereby dismissed.

7. Learned counsel for the appellants submits that he shall seek instructions and file Vakalatnama on behalf of appellant nos. 2 to 6 within a period of 4 weeks from today.

8. Let the Vakalatnama be filed by 11th April 2025.

9. This appeal is admitted for final hearing.

10. In case Vakalatnama is not filed, the appellant nos. 2 to 6 will be arrayed as proforma respondents in this case.

11. Let the records be called for from the learned Court concerned.

12. Let notice be issued to the respondents for which requisites etc. under ordinary process be filed within a period of two weeks from today.

13. Post this case on 10th June 2025 under appropriate heading.
