1. This limitation application is allowed, since it is not opposed.

2. Having regard to the law declared by the Supreme Court in

Capt. M. Paul Anthony versus Bharat Gold Mines Limited and

another, (1999) 3 SCC 679, and also the judgment of the Supreme

Court in State Bank of India and Others versus R.B. Sharma,

(2004) 7 SCC 27, that where departmental proceedings and criminal

case are based on same set of facts, and evidence in both the

proceedings are common, it is desirable to stay the departmental

proceedings, there shall be a stay of all further proceedings in the

departmental enquiry against the appellant, including passing of final

orders pursuant to the 2nd show-cause notice said to have been

issued to the appellant.

3. Admit.

4. Notice to the respondents.

5. Mr. Sahbaj Akhtar, A.C. to A.A.G.-III, accepts notice for the

respondents.

6. List this case in due course for hearing.
