Heard learned counsel for the petitioner in this interlocutory application for exemption to the petitioner from surrendering on the ground that a joint compromise petition has been filed on behalf of both the parties, and further for disposing of the instant criminal revision in the terms of compromise entered between both the sides.

The aforesaid Criminal Revision has been filed against the judgment of conviction and sentence passed by the learned Trial Court under Section 138 of the N. I. Act and the same has been affirmed in appeal, sentencing the Petitioner to undergo simple imprisonment for one year and also to pay fine of Rs.8,00,000/- by way of compensation.

In view of the settlement between both sides, the petitioner was exempted from surrendering by the order passed by this Court on 21.01.2025 in I.A. No. 208 of 2025. Out of settlement of Rs. 8,00,000/-, a sum of Rs.6,00,000/- was earlier paid and Rs. 2,00,000/- has also been paid by this petitioner by way of demand draft of Rs. 2,00,000/- and deposited in the office of learned Registrar General of this Court.

In view of the compromise entered into between both sides and the payment of the compensation amount, this criminal revision is disposed of, in terms of compromise and the petitioner is acquitted of the charges under Section 138 of the N.I. Act for which he was convicted.

Opposite party no. 2 is permitted to receive the balance of Rs. 2,00,000/- for which the demand draft has been submitted in the office of the Registrar General.

I.A. No. 209 of 2025 is allowed and criminal revision is accordingly disposed of.

Pending I.A., if any, stands disposed of.
