Learned counsel for the petitioner has produced the original Demand Draft of Rs.1,50,000/- and photo copy of the said Demand Draft in the name of O.P. No.2 before this Court which is amount of compensation as per the direction of the learned Court below.

I.A. No.12214 of 2024

2. I.A. No.12214 of 2024 has been filed on behalf of the petitioner under Section 5 of the Limitation Act for condoning the delay of 148 days.

3. Learned counsel for the petitioner has submitted that he is ready to deposit the Demand Draft of Rs.1,50,000/- (Rs.One Lakh Fifty Thousand) in the office of learned Registrar General without prejudice to his case. The petitioner is the Clerk of the main accused namely Manoj Kumar Mishra and the petitioner was suffering from financial crisis and hence the delay of 148 days in filing the instant Criminal Revision Application may be condoned.

4. Learned Spl.PP has raised objection.

5. Having heard both the sides and considering the fact that the petitioner has deposited the compensatory amount in

question, the delay of 148 days in filing the instant Criminal Revision Application is condoned.

6. Thus, I.A. No.12214 of 2024 is allowed and stands disposed of.

7. This Criminal Revision Application has been filed on behalf of the petitioner challenging the judgment dated 11.03.2024 passed by Sri Niraj Kumar Srivastav, learned Sessions Judge, Palamau in Cr. Appeal No.18 of 2023 by which the appeal filed on behalf of the petitioner has been dismissed thereby affirming the judgment of conviction and order of sentence dated 27.02.2023 passed by Sri Nirupam Kumar, learned Chief Judicial Magistrate, Palamau at Daltonganj in Sadar P.S Case No.96 of 2017, corresponding to G.R. Case No.1517 of 2017( T.R No.421/2023) by which the petitioner has been convicted for the offences under Sections 406 and 420 of the IPC and sentenced to undergo R.I for two years and two years respectively to pay the with fine of Rs.5,000/ and to pay compensation of Rs.1,50,000/- to the informant.

8. I.A. No.485 of 2025 has been filed on behalf of the petitioner for grant of bail, during pendency of the present Criminal Revision Application.

9. It is submitted that the petitioner is ready to settle the dispute with the O.P. No.2 and willing to deposit the Demand Draft of Rs.1,50,000/- in favour of O.P. No.2. It is submitted that the petitioner is in custody since 13.01.2025 and he is the Clerk of the main accused namely, Manoj Kumar Mishra and hence he may be enlarged on bail.

10. On the other hand, learned APP has raised objection.

11. Having heard learned counsel for both the sides and considering the fact that petitioner is ready to deposit Rs.1,50,000/- in favour of O.P. No.2 and has produced the Demand Draft before this Court, the petitioner namely, Chandrashekhar Kumar Singh is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj, in connection with Sadar P.S Case No.96 of 2017, corresponding to G.R. Case No.1517 of 2017 (T.R No.421/2023).

12. Thus, I.A. No.485 of 2025 is allowed and stands disposed of.

13. Let the Demand Draft of Rs.1,50,000/- be deposited by the learned counsel for the petitioner in the office of the learned Registrar General by tomorrow (i.e. 28.01.2025) and which may be kept in safe custody by the office of the learned Registrar General till further order of this Court.

14. Let a copy of this order be sent to the office of the learned Court below by Fax and also sent to the office of the learned Registrar General.

15. Issue notice upon the O.P. No.2 by registered post with A/D as well as ordinary process, for which requisites etc. must be filed within two weeks from today.

16. Put up this case on 11.03.2025.

17. Call for the scanned copy of the Lower Court Records

18. Let the name of Mrs. Priya Shrestha, learned Spl.PP be appeared in the daily cause list henceforth.
