02/26.08.2025: Issue notice to respondent No.2, on filing requisites etc. under Speed Post as well as under ordinary process within a week.
The respondent(s) are directed to file response in the matter.
By referring to judgment of the Hon'ble Apex Court, it has been submitted that the process has not been followed and as such it does not come under the definition of award.
From the pleading(s) of the parties, it appears that the entitlement to receive the amount is not in dispute, rather there is dispute between the respondent No.3 and the petitioner.
In that view of the matter, this Court is not inclined to stay the proceeding in Case No.01(MSME) 2024-25, pending before Auction Paper Officer-cum-Deputy Election Officer, Ranchi.
Accordingly, I.A. No. 11091 of 2025 stands dismissed.
