1. Mr. A.K. Kashyap, the learned senior counsel appearing for the petitioner has sought for leave of this Court to withdraw this criminal miscellaneous petition in view of the amendment in the Code of Criminal Procedure.

2. The learned APP appearing for the State has raised no objection to the same.

3. Leave, as prayed for, is granted.

4. Considering the aforesaid submission, the instant criminal miscellaneous petition is dismissed as withdrawn with the liberty to the petitioner to approach the appropriate Forum as provided under the Statute.
