This Interlocutory Application has been filed by the

appellant praying therein to suspend the sentence and release him

on bail during pendency of this appeal.

2. It is the second attempt of the appellant praying to

release him on bail after suspension of sentence. Earlier his

application for suspension of sentence was dismissed vide order

dated 29.07.2024 passed in I.A. No.5173 of 2024.

3. The appellant has been convicted in connection with

N.D.P.S. Case No.34 of 2020 / N.D.P.S. Case No.34 of 2020 A, in the

Court of District & Additional Sessions Judge-I, Khunti, for offence

under Section 18 of the NDPS Act. He has been sentenced to undergo

rigorous imprisonment for ten years, with fine of Rs.1,00,000/-.

4. Heard, learned counsel representing the appellant,

learned A.P.P. representing the State and learned counsel

representing the informant, and have gone through the impugned

judgment, the evidence and the Trial Court Records.

5. Opportunity was given to learned A.P.P. representing the

State, to oppose the bail, which she availed and opposed.

6. At present, there is no change of circumstance to

reconsider the application of this appellant for suspension of

sentence. The commercial quantity of opium was recovered from the

possession of this appellant. Thus, we are not inclined to allow this

application.

7. This interlocutory application is, accordingly, dismissed.

8. The appellant will be at liberty to file an application for

early hearing of this appeal.

9. The office is directed to prepare the paper book also.
