On call, the learned counsels for the parties have appeared. The learned counsel for the petitioner submits that matter was compromised between the parties through mediation on payment of Rs. 15 lakhs. He has further stated that petitioner has already paid Rs.10,00,000/- which is apparent from page-4 of the impugned judgment wherein it is stated that CW-1 Bandana Devi has deposed that the petitioner agreed to pay the amount in installment who has paid Rs. 10,00,000/- and the compromise petition has also been filed in the instant case. He has further stated that CW- 2 Shashi Kumar Dubey in his examination-in-chief has deposed in the same line. The learned counsel for the petitioner has further stated that the petitioner is ready to pay the remaining amount to the opposite party no.2 and they will file a joint compromise petition by the next date, therefore, he may be exempted from surrendering before the learned trial court.

The learned counsel appearing on behalf of opposite party no.2 seeks adjournment for seeking instruction from his client.

In view of the above, list this case on 23.9.2024. The petitioner is exempted from surrendering in the learned court below till the next date of hearing.
