21/30.01.2024 Heard Mr. Sameer Saurabh learned counsel for the appellant and Mr. Dilip Kr. Chakraverty learned counsel appearing for the respondent.

This appeal is directed against the judgment and decree dated 28.09.2018 (decree signed on 4.10.2018) passed by Sri Yogeshwar Mani, learned Principal Judge, Family Court, Bokaro in connection with Original Suit No.137/2014 whereby the suit preferred by the petitioner (appellant herein) under Section 13(1) (i-a) & (i-b) of the Hindu marriage Act for dissolution of marriage has been dismissed.

3. During pendency of this proceeding the matter appears to have been compromised between the parties on certain terms and conditions which find mention in I.A. No.11316 of 2023.

4. Mr. Sameer Saurabh, learned counsel appearing for the appellant has submitted that out of agreed amount of Rs.21 lakhs, Rs. 6 lakhs have already been paid to the respondent and so far as the balance amount of Rs.15 lakhs is concerned he has fixed deposited an amount of Rs.7,50,000/- each in the name of son and daughter of the parties. The copies of the fixed deposit receipts have been submitted at the bar by the learned counsel for the appellant.

5. Mr. D. K. Chakraverty learned counsel appearing for the respondent submits that since the matter has been compromised between the parties, this first appeal may be disposed of in view of the said compromise.

6. Since an interlocutory application which is a joint compromise application has also referred to Section 13-B of the Hindu Marriage Act and in view of the fact that the matter has been compromised between the parties this appeal stands disposed of in terms of the settlement arrived at between the parties and the marriage between the parties is dissolved. Let the terms of settlement form part of the decree. Decree accordingly.

The appeal stands disposed of. Consequently, I.A. No.11316/2023 also stands disposed of.

7. Let the photocopies of the FDRs, the original of which have been handed over to the learned counsel for the respondent be kept on record.
