This interlocutory application has been filed for stay the further proceeding of Claim Execution Case No. 04 of 2018 during pendency of instant appeal, which is pending before learned District Judge-II, Dumka.

Learned counsel for the appellant submits that the earlier stay was granted by this Court vide order dated 16.08.2018 and learned tribunal has vacated the stay in light of the Judgment rendered in Asian Resurfacing of Road Agency Pvt. Lt. & Anr. versus Central Bureau of Investigation reported in 2018 (2) JBCJ 235 (SC). It is further submitted that the appellant stands to suffer irreparable injury, if further proceeding in Execution Case is not stayed.

In the facts and circumstances of the case, until further orders further proceedings of Execution Case No. 04 of 2018 pending before the Court of learned District Judge II, Dumka shall remain stayed.

IA No. 2681 of 2023 stands disposed of.
