Learned Counsel Mr. Mahavir Prasad on behalf of the

petitioner and on behalf of the State, learned A.P.P. are present.

2. This Interlocutory Application is for condonation of delay in

preferring the instant Cr. Revision against the impugned order.

3. The reason is shown that the petitioner is Hawker of

readymade cloths and used to go to various fairs in various

Districts and also out of State could not come back and when he

came back in August, 2023, he came to know in regard to the

instant Judgment. He immediately surrendered before the

court-below on 08.08.2023 and thereafter making the

arrangement of money preferred this Cr. Revision.

4. In view of the reasons mentioned for delay are found

sufficient.

5. The delay of 176 days in preferring this Cr. Revision is

condoned.

Accordingly, I.A.No.8643 of 2023 stands disposed of.

Criminal Revision No. 1157 of 2023

Admit.

2. Notice be issued to the O.P.No.2 through the Police Station

concerned.

3. O.P.No.1-State is directed to ensure service of notice to the

O.P.No.2 and to file affidavit to this effect on or before the date

fixed.

4. List on 02.11.2023.
