I.A. No.8233 of 2023 in L.P.A. No.452 of 2023 This is an application under Section 5 of the Limitation Act filed by the appellant to condone the delay of 43 days in preferring the appeal.

I.A. No.8163 of 2023 in L.P.A. No.463 of 2023 This is an application under Section 5 of the Limitation Act filed by the appellant to condone the delay of 12 days in preferring the appeal.

Learned counsel, Mr. Sumeet Gadodia appearing for the appellant would submits that appeals against the combined judgment passed by the learned Single Judge in two different writ applications and inadvertently because of oversight, the Advocate Clerk of the learned Advocate obtained only one certified copy and therefore both the appeals could not be filed in time as took some more time to obtain second certified copy of the impugned judgment.

In that view of the matter, as there is no serious objection by learned counsel for the respondents, we are inclined to condone the

delay of 43 days and 12 days respectively in filing the appeals. Hence, the delay in filing both the appeals is hereby condoned.

Both the Interlocutory Applications i.e. I.A. No.8233 of 2023 in L.P.A. No.452 of 2023 and I.A. No.8163 of 2023 in L.P.A. No.463 of 2023 stand disposed of.

LPA No. 452 of 2023 and LPA No.463 of 2023 List these cases on 17.10.2023 as fresh filing.
