Order No.13/ Dated:03.10.2023 Learned counsel for the petitioner has submitted that in this Civil Miscellaneous petition, there is a prayer for stay of further proceeding of the suit which was not granted earlier but the learned court below has closed the evidence of petitioner/defendant and proceeded for hearing the argument, in case the judgment is passed in the Original Suit No. 49 of 2013, this application shall become infructuous.
Under such circumstances, further proceeding of the suit is to be stayed till the disposal of this application.
Learned counsel for the respondent has opposed the aforesaid prayer.
Considering the above facts and circumstances and the urgency of matter, I feel inclined to stay the further proceeding of the Original Suit No. 49 of 2013, pending before the Court of learned Civil Judge, Senior Division Ist Class, Jamtara till further order.
Heard the complete argument of both parties.
