2. Learned defence counsel appearing on behalf of the appellant submitted one I.A. No. 2545 of 2023 has been filed on behalf of the appellant with a prayer to enlarge the appellant on bail during pending of this appeal, which has been preferred against the judgment of conviction and order of sentence dated 08.11.2019 passed by learned Sessions Judge, Simdega, in Sessions Trial No. 159 of 2015, arising out of Simdega P.S. Case No. 56 of 2013, corresponding to G.R. Case No. 206 of 2013, whereby and whereunder this appellant has been convicted for the offence punishable under sections 323, 324 & 504 of the Indian Penal Code and sentenced him to undergo R.I. for 6 months for the offence under Section 323 of the Indian Penal Code, further sentenced him to undergo R.I. for one year and fine of Rs. 2,000/- for the offence under Section 324 of the Indian Penal Code, further sentenced him to undergo R.I. for 6 months and fine of Rs. 1,000/- for the offence under Section 504 of the Indian Penal Code and in default of payment of fine, appellant will further undergo S.I. for three months and all the sentences were directed to run concurrently. The period of custody already undergone by the appellant will be set off under Section 428 of the Cr.P.C.

3. It has been pointed out that on the strength of the NBW issued by the concerned court below, the appellant was arrested on

13/01/2023 and the maximum sentence awarded to the appellant in this case is one year. Further it has also been pointed out that on earlier occasion, the appellant was granted provisional bail by the learned court below just after the judgment of conviction and order of sentence and since the appellant could not file the extension of the provisional bail within time and therefore his provisional bail could not be confirmed by this Court.

4. Learned APP appearing on behalf of the State did not controvert this fact that on earlier occasion the appellant was on provisional bail and later on by the order of this Court, the appellant has been arrested in this appeal and he is in jail since 13/01/2023 till as on date.

Having taken into consideration the aforesaid submission, the appellant is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the court of learned Sessions Judge, Simdega, in Sessions Trial No. 159 of 2015, arising out of Simdega P.S. Case No. 56 of 2013, corresponding to G.R. Case No. 206 of 2013, subject to the conditions as laid down under Section 439 of Cr.P.C.

6. I.A. No. 2545 of 2023 gets disposed of accordingly.

7. This appeal is already admitted and the scanned copy has also already been received.

8. Let this case be posted under the heading 'for hearing' in seriatim.
