04/ 01.05.2023 This petition has been filed for a direction upon the respondent Nos. 2 to 5 to arrest the respondent No. 6, in connection with Dalbhumgarh P.S. Case No. 49 of 2022, pending in the court of learned Sub-Divisional Judicial Magistrate, Ghatshila.

2. Learned counsel appearing for the petitioner submits that the petitioner has approached the concerned authorities, however, no action has been taken.

3. Learned counsel appearing for the State submits that the petitioner is having the alternative remedy.

4. Considering that the petitioner is having the alternative remedy even for proper investigation, he may approach the learned court in view of the judgment of Hon'ble Supreme Court in the case of Sudhir Bhaskarrao Tambe Versus Hemant Yashwant Dhange & Ors., reported in (2016) 6 SCC 277.

5. In view of the above, learned counsel appearing for the petitioner seeks permission to withdraw this petition to avail the alternative remedy.

6. Accordingly, this petition is dismissed as withdrawn with the aforesaid liberty.
