2. Learned counsel for the petitioner has submitted that a supplementary affidavit has been filed mentioning that the petitioner was never put under suspension in connection with the present allegation. He has submitted that the entire proceeding sought to be initiated against the petitioner is barred in view of the provision of Section 43 (b) of Jharkhand Pension Rules.
3. Learned counsel for the respondents is directed to seek instructions and file a counter-affidavit in the present case in connection with the specific stand taken by the petitioner that the proceeding is barred in view of the Rule 43 (b) proviso (a) (ii) of the Jharkhand Pension Rules and as per the writ petition, the present case is covered by the judgment passed in W.P.(S). No.5065 of 2014 dated 30.01.2015 provided in L.P.A. No.580 of 2015 dated 18.06.2020 and also other judicial pronouncements.
4. The counter-affidavit of the respondents be filed by 03.08.2023.
