05/12.01.2023 Learned counsel for the petitioner Mr. Nitin Kumar Pasari submits that present case is covered by the judgment passed in L.P.A. No. 333 of 2015 and other analogous cases whereby the appeal filed by Jharkhand Urja Vikas Nigam Limited has been dismissed. He submits that Special Leave to Appeal (C) No. 27764 of 2016 is pending before the Hon'ble Supreme Court against the judgment passed in L.P.A. No. 333 of 2015 and the matter has been directed to be listed on 20.01.2023. He submits that the matter may be adjourned awaiting final outcome of the judgment to be passed by the Hon'ble Supreme Court.

2. Accordingly, the matter is adjourned and is directed to be posted on 02.03.2023.

3. Learned counsel for the petitioner would apprise this court in advance regarding the outcome of the aforesaid SLP.
