No one turns up on behalf of the parties in-spite of repeated calls.
Perusal of the record reveals that this interlocutory application has been filed with a prayer to condone the delay of 255 days in filing this appeal.
Perusal of the interlocutory application reveals that the appellant who is in defence establishment came to know about the impugned judgment through email at Sewak/82 RCC Indo Mayammar in the State of Manipur and it took some time for the appellant to take appropriate steps for filing the appeal and the same resulted in delay in filing this appeal. It is then averred in the petition that the appellant has very good grounds to agitate in this appeal and the delay was neither intentional nor deliberate and unless the delay of 255 days is condoned, the appellant will be highly prejudiced.
Considering the aforesaid facts, the delay of 255 days in filing this appeal is condoned.
This interlocutory application stands disposed of accordingly.
