07 / 09.02.2023 I.A. No. 6296/2022 has been preferred by the appellant for suspension of sentence. Appellant would be completing eight years of custody on 29.04.2023. On that basis, appellant has renewed the prayer for suspension of sentence relying upon the decision of the Apex Court in the case of Saudan Singh vs. The State of Uttar Pradesh vide judgment dated 25.02.2022 passed in Cr. Appeal No. 308/2022 (@ SLP (Crl.) No. 4633/2021).

2. However, since the appellant is still short of few months from completion of eight years of custody against the sentence of twenty years awarded upon him under section 376-D of the Indian Penal Code, as prayed for, list the case in the first week of May 2023.
