1. Apprehending his arrest, the applicant has approached this Court for grant of privilege of anticipatory bail, in connection with Madhupur P.S. Case No.194 of 2023, registered for the offence under Sections 414/34 of the Indian Penal Code, Section 54 of the Jharkhand Minor Minerals Concession Rules, Sections 4/21 of the Mines and Mineral Development and Regulation) Act & Section 15 of the Environment Protection Act, pending in the court of learned Additional Chief Judicial Magistrate, Madhupur.

2. Learned counsel for the applicant seeks permission to withdraw the present anticipatory bail application with a liberty to approach the Court below for grant of regular bail.

3. Permission is accorded.

4. Accordingly, the present anticipatory bail application is dismissed as withdrawn with the aforesaid liberty.

5. The Court below is directed to consider the same on its own merit keeping in mind the judgment of the Hon'ble Apex Court.
