I.A. No. 5094 of 2023 03/ 11.08.2023 Heard learned counsel for the petitioners.

This interlocutory application has been filed for staying the execution and operation of order dated 19.04.2023, passed in Execution Case No. 03 of 2022.

It has been submitted by learned counsel for the petitioners that in most cryptic manner, Appellate Court has reversed the order of the learned Court.

From perusal of the order it appears that mechanically the order has been passed. The Civil (Eviction) Appeal No. 06 of 2016 was preferred by plaintiff-defendant against judgment dated 31.08.2016 and decree dated 14.09.2016, passed in Eviction Suit No. 07 of 2008.

Prima facie case is made out. Balance of convenience lies in favour of the petitioner.

As such, further proceeding in Execution Case No. 03 of 2022 is hereby stayed.

I.A. No. 5094 of 2023 stands allowed. Civil Revision No. 20 of 2022 Let notices be issued to sole respondent through Registered Cover with A/D as well as under Ordinary Process, for which requisites, etc. must be filed within a period of two weeks.

List this case thereafter.
