The learned counsel for the appellants submits that this interlocutory application has been filed with a prayer to ignore the defect as pointed out by the stamp reporter at serial no. 4.

It is submitted by the learned counsel for the appellants that the defect pointed out by the stamp reporter at serial no.4 is that respondent no.8 of the certified copy of the decree under appeal has not been made party in this appeal. It is next submitted by the learned counsel for the appellants that the respondent no.8 of Title Appeal No. 44 of 2006 namely Most. Manti Devi died on 08.04.2021 after pronouncement of the judgment on 27.02.2021 but before filing of this appeal on 09.06.2021 leaving behind her legal representatives as respondent nos. 8 (a) to 8 (g) of Title Appeal No. 44 of 2006 and all of them have been impleaded as respondent nos. 20 to 26 in this second appeal. Hence, it is submitted that the defect pointed out by the stamp reporter at serial no.4 be ignored.

Considering the aforesaid facts, the defect pointed out by the stamp reporter at serial no.4 is ignored.

This interlocutory application stands allowed accordingly.
