06/ 19.09.2022. Learned counsel for the petitioner, Mr. Kripa Shankar Nanda has submitted, that petitioner has prayed to change his name in Class-X and Class- XII certificate from Prince to Prince Singh as his UID Card, Voter identity card as well as Passport have been issued in the name of Prince Singh though in Class-X certificate and Class-XII certificate, his name has been recorded by the Central Board of Secondary Education, Delhi as Prince.
Learned counsel for the respondent- UOI, Mr. Prashant Kr. Singh and learned counsel for the respondent no.2, Mr. Mohan Dubey have submitted, that petitioner has no reason to prefer the writ petition before this Court, in view of judgment passed by the Apex Court in this case of Jigya Yadav vs. C.B.S.E. (Central Board of Secondary Education) & Ors., reported in 2021 (7) SCC 535 where the Hon'ble Supreme Court has permitted to change the name of person, if it differs from the school document, but in the case of the petitioner, petitioner has no case that in his school document his name has been recorded as the Prince Singh rather petitioner is admitting, that his name is recorded as the Prince, as such, such opportunity may not be granted by this Court which will open the Pandora box creating mess of the system by changing the name in the Class-X certificate, which will also give an opportunity to change the date of birth or to make some confusion in the certificate, which are essential for verification regarding identity of person. However, three weeks' time may be granted to file detail counter-affidavit in this matter.
Considering the same, three weeks' time is granted to file counter- affidavit.
