2/11.10.2022 This petition has been filed for quashing of the order dated 29.08.2022 passed by the learned Additional Sessions Judge-IV, Jamshedpur, in connection with S.T.No.330 of 2017, arising out of Mango P.S.Case No.188 of 2017 (G.R.No.1681 of 2017), whereby the learned court has been pleased to issue non- bailable warrant against the petitioners and further notice was issued against the bailors of the petitioners, pending in the court of learned Additional Sessions Judge-IV, Jamshedpur.

The learned counsel for the petitioner submits that the case has been fixed for the judgment and on the date of delivery of judgment a petition has been filed along with the medical certificate disclosing that the petitioner has suffered from Covid-19. He submits that the petitioner will appear before the learned court on any date fixed by this Court.

Mrs. Priya Shrestha, the learned counsel appearing for the respondent State submits that the case is running for judgment and earlier also the petitioner has moved before this Court for cancellation of bail and this Court has allowed the said petition. She submits that intentionally the petitioner is not appearing before the learned court.

In view of the above facts and submissions of the learned counsels appearing for the parties and also considering that the petitioner is ready to appear before the learned court, this petition is being disposed of directing the petitioner to appear before the learned court on or before 17.10.2022.

If the petitioner appears before the learned concerned court on or before the said date, the warrant shall not be given effect to.

It is made clear that if the petitioner fails to appear on or before the said date before the learned concerned court, all coercive steps shall be taken against the petitioner.

Disposed of.
