03/ 05.05.2022 Heard Mr. Santosh Kumar Soni, learned counsel appearing for the petitioner and Mr. Shiv Shankar Kumar, learned A.P.P. for the State.
This petition has been filed by the informant on the ground that the chargesheet has not been submitted under Sections 307 and 354 of the Indian Penal Code, however, ingredients of those Sections are available in the FIR.
The Court below has taken the cognizance for the offences under Sections 147, 148, 149, 323, 324, 504, 506 of the Indian Penal Code.
In view of Section 216 of the Cr.P.C., any charge can be altered at any stage before pronouncement of the judgment.
This petition is misconceived. The petitioner may demonstrate his case at the appropriate stage.
As such this petition is disposed of.
