04/ 28.02.2022 Learned counsel appearing for the petitioner submits that the complaint, which has been sent to the police station for registration and investigation under Section 156(3) Cr.P.C. is not in accordance with law. He submits that the case is arising out of a matrimonial dispute. He further submits that the present case is fully covered by the judgment of the Hon'ble Supreme Court in the case of Anil Kumar Versus M.K. Aiyappa, reported in (2013) 10 SCC 705 and in the case of Babu Venkatesh & Ors. Versus State of Karnataka & Anr., in Criminal Appeal No. 252 of 2022 (decided on 18.02.2022).
Let notice be issued upon the O.P. No. 2 under registered cover with A/D as well as by ordinary process, for which, requisites etc. must be filed within two weeks.
No coercive step shall be taken against the petitioner, in connection with Jagarnathpur P.S. Case No. 189 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Ranchi till the next date of listing.
