The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

05/16.02.2022: This interlocutory application has been filed by the petitioner for condonation of delay of 133 days in filing present criminal revision.

In view of the statements made in the interlocutory application, the delay in filing criminal revision, is hereby, condoned.

The aforesaid interlocutory application stands allowed. Cr. Rev. No. 1417 of 2019 Heard.

This criminal revision has been filed by the revisionist against the judgment and order dated 18.02.2019 passed by learned Principal Judge, Family Court, Giridih in Original Maintenance Case No.07 of 2017 by which application filed under Section 125 Cr.P.C. by the Opp. Parties, has been allowed by directing the revisionist to give Rs.3000/- per month to the wife and Rs.1,000/- to the minor daughter as maintenance.

It has been submitted that there is subsequent development and some maintenance has been awarded by the Court while granting anticipatory bail. Further, there is compromise between the parties.

In view of the above submission, counsel for the revisionist seeks permission to withdraw this criminal revision, giving liberty to the revisionist to approach before the court below by filing petition under Section 127 Cr.P.C.

Permission is granted with the aforesaid liberty. This criminal revision is accordingly dismissed as withdrawn. If any such petition is filed, the court below is directed to dispose of the same as soon as possible, without being prejudiced by the order of this Court.
