05/ 21.12.2022 It has been submitted by learned counsel for the petitioner that though petitioner was promoted from the post of Constable to ASI but later on he was reverted to the post of Constable. Learned counsel places heavy reliance to the judgment passed by the Division Bench of this Hon'ble Court in W.P.(S). No. 3115 of 2015 and other analogous cases and submits that it has been held by the Division Bench that degree obtained from Deoghar Hindi Vidyapith is valid upto 26.02.2015 and since the petitioner has obtained his degree prior to 26.02.2015, his case ought to have been considered by the respondents.

On the other hand, Mr. Indranil Bhaduri, learned counsel appearing for the respondent-State submits that admittedly the validity of the certificate issued by the Deoghar Hindi Vidyapith was valid upto 26.02.2015 but since the promotion of the petitioner was given in the year 2018 on the basis of said certificate and as such, rightly he was reverted back to the post of Constable.

As prayed, list this case along with W.P.(S). No. 6048 of 2019, in the 2nd week of February, 2023.
