/By the Court

1. Heard learned counsel for the appellants and learned A.P.P.

2. The present appeal has been preferred against the judgment of conviction dated 18.01.2012 and order of sentence dated 21.01.20121, passed by the court of learned Principal Sessions Judge, Giridih, in Sessions Trial No.385 of 2006, whereby the appellants have been convicted for the offence under Sections 147/ 148/ 323/ 325 read with Section 149 of the Indian Penal Code and they have been given the benefit under Section 4 of the Probation of Offenders Act by directing them to furnish bond of Rs.5,000/- with two sureties each to the satisfaction of court below for maintaining peace and good behaviour for a period of two years.

3. It appears that the sentencing has been considered under Section 4 of the Probation of Offenders Act and they have been directed to maintain peace and good behaviour for a

period of two years. The said period has already been passed and as such there is no adverse order against the appellant so far as sentencing part is concerned.

In that view of the matter, learned counsel for the appellants has submitted that the appellants are not interested in pursuing the present appeal.

4. In view of the submission of learned counsel for the appellants, the present criminal appeal stands dismissed as infructuous.
