03/ 30.08.2022 Learned counsel appearing for the petitioner submits that the joint account is in the name of petitioner and her husband and husband of this petitioner has signed the cheques, however, the petitioner has not signed the cheques in question. He submits that this case is fully covered by the judgment of the Hon'ble Supreme Court in the case of Aparna A. Shah Versus Sheth Developers Private Limited & Anr., reported in (2013) 8 SCC 71.
Let notice be issued upon the O.P. No. 2 under registered cover with A/D as well as by ordinary process, for which, requisites etc. must be filed within two weeks.
Substance of accusation shall not be explained to the accused persons, in connection with C.P. Case No. 1283 of 2019, pending in the court of learned Judicial Magistrate, 1st Class, Bokaro, till the next date of listing.
