2. Learned counsel for the petitioner has submitted that the case of the petitioner is squarely covered by the judgment passed by this court in L.P.A. No. 426 of 2012 which has been annexed along with I.A. No. 137 of 2018. Learned counsel has also submitted that the civil appeal filed against the aforesaid judgment passed in L.P.A. No. 426 of 2012 has been dismissed by the Hon'ble Supreme Court in Civil Appeal No. 3111 of 2016. The learned counsel has also relied upon judgment passed by this court in W.P. (S) No. 3439 of 2016 disposed of on 25.07.2016; W.P. (S) No. 5985 of 2007 along with other analogous cases disposed of on 17th April, 2018; W.P. (S) No. 389 of 2016 disposed of on 04.04.2018 and W.P. (S) No. 2130 of 2016 disposed of on 01.08.2018. Learned counsel has also relied upon the judgment passed in W.P. (S) No. 5147 of 2015.
