06/26.04.2022. Only FIR is under challenge in this petition.

Learned counsel for the petitioner submits that other co-accused persons have been acquitted and the petitioner is one of the accused. In the identical situation, the Hon'ble Supreme Court has protected the appellant of that case in the case of Umesh v. State of Kerala in Criminal Revision No.227 of 2017 vide judgment dated 03.02.2017.

This Court is not inclined to quash the FIR, at this stage in view of the fact that what are the materials in the charge-sheet, is not before this Court as the charge-sheet has already been submitted and the other accused persons had faced the trial and thereafter the acquittal order has been passed.

At this stage, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to take all the grounds at appropriate stage.

Learned counsel for the State as well as opposite party no.2 have got no objection.

Accordingly, this petition is permitted to be withdrawn and the same stands disposed of.
