06/29.10.2021. This petition has been taken through Video Conferencing in view of

the guidelines of the High Court taking into account the situation arising due

to COVID-19 pandemic.

Learned counsel for the petitioner is not pressing I.A. No.2213 of

2021.

Accordingly, I.A. No.2213 of 2021 stands dismissed as not pressed.

I.A. No.5985 of 2021 has been filed for extension of interim order

dated 27.11.2019.

Learned counsel for the petitioner submits that in view of the

judgment rendered by the Hon'ble Supreme Court in the case of Asian

Resurfacing of Road Agency Private Ltd. and another v. Central

Bureau of Investigation, reported in (2018) 16 SCC 299, the learned

court below is proceeded in the case and that is why, it has been

necessitated to file the said I.A.

Mr. Vishal Kumar, learned counsel for opposite party no.2 and Mr.

Navneet Toppo, learned counsel for the State are opposing the extension of

interim order.

However, Mr. Vishal Kumar, learned counsel for opposite party no.2 is

seeking time for filing the counter affidavit.

In view of the above facts and considering that this matter is still

pending and opposite party no.2 is seeking time for filing the counter

affidavit, in the interest of justice the prayer made in the said I.A. is

allowed.

Interim order dated 27.11.2019 is extended, till the next date.

Accordingly, I.A. No. 5985 of 2021 stands disposed of.

Post this matter under the heading for Admission on 02.03.2022.
