2. Mr. Prem Mardi learned counsel for the petitioner,
after some argument, submits that the instant writ application
may be disposed of by giving liberty to the petitioner to
approach the "Grievance Cell" (Grievance Redressal
Committee) as per Clause 4.1.1 sub clause 3 of R&R Policy. He
further submits that the grievance cell may be directed to
adjudicate the issue raised by the petitioner in the instant writ
application and pass an appropriate order by giving appointment
to this petitioner.
3. Mr. Sudarshan Srivastava assisted by Mr. M.B. Lal,
learned counsel for the respondents submits that it is only the
grievance cell which can adjudicate the issue involved in this
case. He further referred to the supplementary counter affidavit
dated 03.04.2013 wherein at paragraph 12 aforesaid clause has
been quoted which clearly transpires that any grievance received
in this regard will be referred to the Grievance Redressal
Committee and the decision of the committee will be final and
binding to all the parties. As such, this writ application may be
disposed of with the liberty to the petitioner as aforesaid.
4. In view of the limited submissions of learned
counsel for the parties, without going into merits of this case, the
instant writ application, is, hereby disposed of by giving liberty
to the petitioners to approach the Grievance Redressal
Committee for redressal of his grievance which has been
constituted as per Clause 4.1.1 sub clause 3 of R&R Policy.
If any such representation / claim is received by the
said Grievance Redressal Committee; same shall be disposed of
after hearing all the parties by passing a reasoned and speaking
order within a period of six months from the date of receipt of
such representation/claim.
5. With the aforesaid observation, the instant writ
application stands disposed of.
