07/27.10.2021 I.A. No.5980 of 2021 The present interlocutory application has been filed on behalf of the petitioner for suspension of sentence, during pendency of the instant criminal revision petition.

The instant criminal revision has been filed against the judgment and order of conviction and sentence dated 03.07.2020 passed by the learned Sessions Judge, Dhanbad in Criminal Appeal No.09 of 2020, who has affirmed the order of sentence and conviction dated 20.12.2019 passed by the Judicial Magistrate, 1st Class, Dhanbad in C.P. Case No.1401 of 2016 and the petitioner has been sentenced to undergo S.I. for six months with a fine of Rs.1,000/- for the offence under Sections 138 of the N.I. Act and in default of payment of fine, further undergo S.I. for 10 days and to pay compensation of Rs.1,40,000/- to the complainant.

It has been submitted by learned counsel for the petitioner that the petitioner has already deposited Rs.14,000/- (Fourteen Thousand) in the court below and he is ready to give Rs.56,000/- (Fifty Six Thousand) after coming out from the jail and for that purpose some more time may be granted.

Learned counsel for the O.P. No.2 has no objection.

In view of above submission, I am inclined to suspend the sentence of this petitioner for six months. Accordingly the petitioner is directed to be enlarged on provisional bail for the period of six months, on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in C.P. Case No.1401/2016.

I.A. No.5980 of 2021 stands disposed of.
