03/ 26.10.2021 Mr. Gaurav Kumar Pandey, learned counsel submits that he has received the vakalatnama and filed the same on behalf of O.P. No. 2 along with Mr. Nagmani Tiwari and he tendered his appearance on behalf of O.P. No. 2. He submits that he may be allowed three weeks time after Diwali Holidays to enable him to file counter affidavit in the case.

Time, as prayed for, is allowed.

I.A. No. 5491 of 2021 has been filed for extension of the interim order dated 05.03.2020 passed in this case.

Learned counsel appearing for the petitioner submits that the Court below is proceeding in the matter and the O.P. No. 2 has filed petition for issuing the non-bailable warrant of arrest against the petitioner, in view of the judgment passed by the Hon'ble Apex Court, in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Anr. Versus Central Bureau of Investigation, reported in (2018) 16 SCC 299. He submits that the aforesaid interlocutory application may be allowed, as the O.P. No. 2 is seeking time in this case.

In view of the aforesaid submission and also the O.P. No. 2 seeks time, the prayer made in the interlocutory application is allowed.

Interim order dated 05.03.2020 shall remain in force till the next date.

The aforesaid interlocutory application is allowed and disposed of.

Post this matter on 18.01.2022.
