This appeal will be heard on the following question of law:-

1) Whether both the courts below failed to appreciate the compromise decree entered into between the appellants and Amrit Mahto in respect of 40 decimals of land over Plot No. 1927 which is a subject matter of the suit.

2) Whether in view of recording in the judgment that the said disputed land which belongs to the ex-landlord was settled in favour of the Amrit Mahto and after vesting, Zamabandi was opened in favour of the Amrit Mahto who paid rent to the government, both the courts could have held that land is a public land.

Issue notice to the respondents for which requisites etc. under registered post with A/D as well as through ordinary process must be filed within three weeks.

In the meantime, call for the lower court record.
