Mr. Ajit Kumar, learned senior counsel for the appellant of Cr. Appeal (S.J.) No.457 of 2019 submits that keeping in view of the fact that the appellant-Kedar Paswan was aged about 71 years on the date of the judgment i.e. on 22.02.2019 and since then he has been in custody as also he was in custody for about two months during the trial and he faced rigors of trial since 1997 to 2019, hence, it is submitted that he will seek instruction from the appellant-Kedar Paswan not to contest the appeal on merit and will only confine his argument on the point of the sentence of the appellant-Kedar Paswan and prays for time.
Mr. Raunak Sahay, learned counsel for the appellant of Cr. Appeal (S.J.) No.364 of 2019 submits that keeping in view of the fact that the appellant- Smt. Sobha Sinha was aged about 68 years on the date of the judgment i.e. on 22.02.2019 and since then she is in custody except the brief period during which she was released on provisional bail and she has been in custody for about twenty three months during the trial and after conviction taken together and she also faced rigors of trial since 1997 to 2019, hence, it is submitted that he will seek instruction from the appellant- Smt. Sobha Sinha not to contest the appeal on merit and will only confine his argument on the point of the sentence of the appellant- Smt. Sobha Sinha and prays for time.
Prayer for time is allowed.
