5/02.11.2021 Learned counsel for the respondent State seeks time for reconstructing the file as he submits that the same has been lost.

Time as prayed for is allowed.

Learned counsel for the petitioners submits that cognizance has been taken under section 27 (d) of Drugs and Cosmetics Act 1940 and non-compliance of section 25 substantial right of the petitioners has been taken away. The sample in question is not supplied to the petitioner in terms of section 25 which is illegal and frustrates the judgment of this Court as well as the Hon'ble Supreme Court.

In view of above, there shall be stay of further proceeding in connection with Drug and Cosmetics Case No.11/2020, pending before the learned AJC-II, Ranchi till the next date.

Let this matter appear on 01.02.2022.
