08/23.06.2021. Heard Mr. Aashish Kumar, learned counsel for the petitioner and

Mr. Rajneesh Vardhan, learned A.P.P. appearing for the opposite party-State.

This criminal miscellaneous petition has been heard through Video

Conferencing in view of the guidelines of the High Court taking into account

the situation arising due to COVID-19 pandemic. None of the parties have

complained about any technical snag of audio-video and with their consent

this matter has been heard.

Status report has been received, whereby, it has been informed that

the case has already been finally disposed of on 23.01.2012.

This petition has been filed for quashing the order dated 13.01.2012

passed in Criminal Revision No.120 of 2010 by the learned Sessions Judge,

Deoghar, whereby, the order dated 23.06.2010 passed by the learned Sub

Divisional Judicial Magistrate, Deoghar in PCR Case No. 963 of 2009/T.R.

No. 1624 of 2010 has been set aside by the learned Sessions Judge,

Deoghar.

Mr. Vardhan, learned A.P.P. appearing for the State submits that there

is no illegality in the impugned order and with the well reasons, the said

order has been passed.

This petition has been filed on 03.03.2012. Thereafter, the case was

listed on 22.03.2012 and 26.04.2012 before the Lawazima, in which,

nobody appeared on behalf of the petitioner. This matter was again listed

before the Bench on 02.01.2013, 06.03.2013 and 27.03.2019 and on all the

dates, adjournment was taken by the learned counsel for the petitioner.

Much time has already been lapsed thereafter and now the petitioner is

pressing this petition. This Court has gone through the impugned order

dated 13.01.2012 passed in Criminal Revision No. 120 of 2010. It transpires

that after appreciating all the legal points including the judgments rendered

by this Court and the Hon'ble Supreme Court, the said order has been

passed. There is no illegality in the impugned order and at this stage, no

relief can be extended to the petitioner.

Accordingly, this criminal miscellaneous petition stands dismissed.
