08 / 24.07.2021 Learned senior counsel for the Appellant submits, on instruction that the appellant who is suffering custody in Birsa Munda Central Jail, Hotwar, Ranchi, is suffering from some illness and other health related issue. Therefore, a report may be called from the jail authorities.

2. Learned counsel for the CBI does not object to the prayer.

3. It appears that a prayer for suspension of sentence has been made on behalf of this appellant through I.A. No. 2851/2021 who is suffering custody in connection with his conviction under sections 120-B/409 of the Indian Penal Code and sections 13 (2) read with 13(1) (c) of Prevention of Corruption Act vide impugned judgment dated 08.11.2017 rendered in R.C. No. 12(A)/2002-R by the Court of learned Spl. Judge, C.B.I./ A.C.B, Ranchi and has been sentenced to undergo R.I for six months under section 120-B of Indian Penal Code; R.I for ten years with a fine of Rs. 50.00 lakhs and default sentence under section 409 of Indian Penal Code and further sentenced to undergo R.I for three years with a fine of Rs. 50.00 lakhs and default sentence under section 13 (2) read with 13(1) (c) of Prevention of Corruption Act, by the impugned order of sentence of the same date.

4. As per the appellant, he remained in custody for three months during trial and since his conviction on 08.11.2017. Let a report about the medical condition of the appellant be submitted by the jail authorities of Birsa Munda Central Jail, Hotwar, Ranchi within a period of two weeks.

5. Let the matter be listed on 10.08.2021.
