Heard, learned counsel, Mr. Sahay Gaurav Piyush on the instruction of learned counsel for the appellant, Mr. Chandrajit Mukherjee.

Learned counsel for the appellant has submitted that I.A. No.818/2021 has been filed to bring subsequent developments on record.

Learned counsel for the appellant has submitted that matter has already been settled between the parties on 14.07.2018 and full & final settlement amount of Rs.10,00,000/- has already been disbursed before the Lok Adalat, Civil Court, Dhanbad and thereafter the Execution Case No.67/2015 was disposed off keeping in view the aforementioned full and final settlement, as such, the appeal may be disposed of in said terms.

Learned counsel for the respondents are not present. However, since such thing has been filed through affidavit, this Court is inclined to accept the same.

Let the instant Miscellaneous Appeal preferred against the judgment dated 17.01.2015 in Title (M.V.) Case No.67/2011 passed by learned District Judge-XIth- cum- M.A.C.T., Judge, Dhanbad is disposed of in terms of the settlement arrived between the parties before the Lok Adalat on 14.07.2018.

Considering the same, the miscellaneous appeal is disposed of. The statutory amount deposited by the appellant at the time of preferring the appeal shall be remitted to the appellant by the learned Registrar General of this Court within a period of four weeks from the date of filing of the requisition.

All pending Interlocutory Applications are hereby closed.
