Learned counsel for the appellants, Mr. Harendra Kumar Mahato, has submitted that though analogous appeal, arising out of the same judgment, has been preferred before this Court vide F.A. No. 88/2012, but the same has been dismissed for default because of non-compliance of order passed by Coordinate Bench. However, C.M.P. No. 274/2020 has been filed for restoration of the same.

Learned counsel for the appellants has submitted that C.M.P. is still pending.

Learned counsel for the appellants has further submitted that today he has served copy of calculation chart upon learned counsel for the respondent-State so as to take instruction from the State as less amount has been paid to the land loosers.

Learned counsel for the State, Mr. Nawal Kishore Pandey, A.C. to Prakash Chandra Roy, S.C. (L&C)-I has submitted that after getting instruction with regard to the amount of compensation claimed by the appellants, he will file detail counter affidavit on these issues.

Put up this case after four weeks along with F.A. No. 88/2012, if restored.
