06/ 15.12.2021      This petition has been heard through Video Conferencing in

view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

By the order dated 28.02.2019 the Officer-in-Charge of Giridih (M) Police Station was directed to return the notice after obtaining the signature of O.P. No. 2, but no communication is available on record on behalf of the concerned Officer-in-Charge.

Learned counsel appearing for the State seeks two weeks time for taking instructions in this regard.

I.A. No. 6970 of 2021 has been filed for extension of the interim order dated 28.02.2019.

Learned counsel appearing for the petitioner submits that the concerned Court is proceeding in view of the judgment passed by the Hon'ble Apex Court, in the case of Asian Resurfacing of Road Agency Pvt. Ltd. & Anr. Versus Central Bureau of Investigation, reported in (2018) 16 SCC 299.

In view of the above facts and considering that this petition is still pending before this Court and O.P. No. 2 has not yet appeared in this case, it is desirable that the interim order dated 28.02.2019 is extended till the next date of listing. As such, the prayer made in the aforesaid interlocutory application is allowed.

The aforesaid interlocutory application stands allowed and disposed of.

Interim order dated 28.02.2019 is extended till the next date. Post this matter on 29.03.2022.
